Please read these Terms of Use ("Terms") carefully before using the Tripigo mobile application ("App" or "Service") operated by Didgigo IP Pty Ltd (ABN 71 151 153 347) ("Didgigo", "us", "we", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
You must be at least 13 years old to use this App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Tripigo is a travel itinerary companion app that allows users to view and manage travel itineraries provided by their travel agent or tour operator. The App includes features such as:
The App includes an AI travel assistant called "Ulysses beta" powered by Google's Gemini AI technology. By using Ulysses beta, you acknowledge and agree that:
The App uses location services to provide map functionality and location-based recommendations. By enabling location services, you consent to the collection and use of your location data as described in our Privacy Policy. You may disable location services at any time through your device settings, though this may limit certain App features.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

The App and its original content, features, and functionality are owned by Didgigo IP Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
Itinerary content displayed in the App is provided by your travel agent or tour operator and remains the property of the respective content owners.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, secure, or error-free; that the information provided is accurate, complete, or current; that defects will be corrected; or that the App is free of viruses or harmful components.
Travel information, including but not limited to flight times, hotel bookings, tour schedules, and contact details, is provided by third parties and may change without notice. Always confirm critical travel details directly with your travel provider.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIDGIGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Didgigo and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.
Apple App Store: If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Didgigo only, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranties or claims relating to the App. Apple is a third-party beneficiary of these Terms.
Google Play: If you downloaded the App from Google Play, you acknowledge that Google has no obligation or liability to you with respect to the App or these Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App with a new "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Didgigo regarding the App and supersede any prior agreements.
